This claim needs to be verified, rather than simply taken at face value.<\/p>\n\n\n\n<p>Georgian legislation does indeed provide for a procedure for changing the designated use of a plot of land \u2014 from agricultural to non-agricultural. This is governed by <a href=\"https:\/\/matsne.gov.ge\/en\/document\/view\/4596113\" rel=\"nofollow noopener\" target=\"_blank\">The Georgian Law \u2018On the Designation of Land Use and the Sustainable Management of Agricultural Land\u2019<\/a> \u0438 <a href=\"https:\/\/www.matsne.gov.ge\/en\/document\/view\/4912808\" rel=\"nofollow noopener\" target=\"_blank\">Decree No. 396 of the Government of Georgia dated 1 July 2020<\/a>. However, the procedure does not automatically guarantee a favourable outcome: the result depends on the specific plot of land, its location, its intended use and the supporting documentation.<\/p>\n\n\n\n<p><strong>A change of use should not be confused with planning permission.<\/strong> These are two different administrative procedures. A plot of land with non-agricultural status does not automatically become suitable for the construction of any building \u2014 to determine this, it will be necessary to ascertain the functional zone and the parameters of permissible development.<\/p>\n\n\n\n<p>This article provides a practical guide, from checking the property\u2019s current status to obtaining an up-to-date extract from the register. It is this status that determines how the plot may be lawfully used.<\/p>\n\n\n\n<p>The Act sets out two main types of appointment:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Agricultural land<\/strong> (Agricultural) \u2014 intended primarily for agricultural activities: crop production, livestock farming, horticulture and related uses.<\/li>\n\n\n\n<li><strong>Non-agricultural land<\/strong> (Non-Agricultural) \u2014 land not classified as agricultural. The possibility of specific development or commercial use is further determined by town-planning documents and planning regulations.<\/li>\n<\/ul>\n\n\n\n<p>The official status of a plot of land can be found in the cadastral extract or information statement issued by NAPR. You can check the status in person at NAPR service centres or via the agency\u2019s official digital channels. <strong>The actual appearance of a plot of land does not constitute proof of its legal status.<\/strong> An empty, overgrown plot on the outskirts of Batumi may well be designated for agricultural use, whilst a plot where buildings were demolished some time ago is classified as non-agricultural. You need to look at the documents, not the land itself.<\/p>\n\n\n\n<p>An important legal point: the fact that land is designated for agricultural use does not, in itself, automatically prohibit all construction. The law permits certain structures on agricultural land, in particular those related to the conduct of agricultural activities. Confusion between \u2018designation\u2019 and \u2018category\u2019 leads to errors both when analysing a plot of land and when making enquiries with the land registry.<\/p>\n\n\n\n<p><strong>Purpose<\/strong> \u2014 this refers to the legal status of a plot of land: agricultural or non-agricultural. It is this status that is changed when people talk about a \u2018change of status\u2019 or a \u2018transfer of land\u2019.<\/p>\n\n\n\n<p><strong>Category of agricultural land<\/strong> \u2014 this is a more detailed classification within the agricultural land use category, describing the current type of land use. The Act identifies the following categories:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Pasture<\/strong> \u2014 land used for grazing livestock;<\/li>\n\n\n\n<li><strong>Haymaking<\/strong> \u2014 land used for haymaking;<\/li>\n\n\n\n<li><strong>Arable land<\/strong>, including land under permanent crops \u2014 land cultivated for agricultural crops or orchards;<\/li>\n\n\n\n<li><strong>Homestead land<\/strong> \u2014 land adjacent to the house, used for a private kitchen garden.<\/li>\n<\/ul>\n\n\n\n<p>The permissible ways of changing driving licence categories are explicitly restricted by law and Decree No. 396 \u2014 it is not permitted to switch between categories at will.<\/p>\n\n\n\n<p>These are two different administrative procedures, each with different grounds and different outcomes.<\/p>\n\n\n\n<p><strong>Practical example 1 \u2014 changing the category without changing the purpose:<\/strong> The plot is designated for agricultural use and is registered as pasture. The owner wishes to use it as arable land. In this case, the issue concerns a change in the category of agricultural land \u2014 whilst its designated use remains agricultural. The procedure is governed by different regulations to those applying to a conversion to a non-agricultural category.<\/p>\n\n\n\n<p><strong>Practical example 2 \u2014 change of purpose:<\/strong> The plot is zoned for agricultural use. The owner plans to build a commercial development or a hotel, which are incompatible with agricultural zoning. In this case, a change of land use is required \u2013 a reclassification from \u2018agricultural\u2019 to \u2018non-agricultural\u2019. This is a different procedure involving a different set of documents, different grounds and a different cost.<\/p>\n\n\n\n<p>It is crucial to understand this distinction before contacting NAPR. An incorrect application may result in rejection or delay the process.<\/p>\n\n\n\n<p><strong>Table 2. First, identify the future project and check whether the \u2018Agricultural\u2019 designation poses a genuine obstacle to its implementation.<\/p>\n<\/blockquote>\n\n\n\n<p>Not every owner of an agricultural plot is obliged to change its designated use. Whether a change is necessary depends on the specific intended use.<\/p>\n\n\n\n<p>A change of purpose will be required in the following typical scenarios:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The owner plans to use the plot for non-agricultural activities that are incompatible with its current status.<\/li>\n\n\n\n<li>A hotel, commercial building or other development is planned which, by its nature, is incompatible with agricultural use.<\/li>\n\n\n\n<li>An analysis of the plot prior to purchase revealed that its status did not correspond to the proposed development plan.<\/li>\n\n\n\n<li>This refers to a commercial development project that requires non-agricultural status in order to obtain planning permission.<\/li>\n\n\n\n<li>The owner is considering a change of use prior to the subsequent sale of the plot. However, the change of use itself does not guarantee an increase in market value or liquidity: the outcome depends on the location, functional zone, building specifications, access, utilities and demand.<\/li>\n<\/ul>\n\n\n\n<p><strong>The issue of detached houses deserves special attention.<\/strong> A change of use is not required in all cases: the current Code on Spatial Planning, Architecture and Construction Activities of Georgia permits the construction of a detached house on private agricultural land, provided that the requirements of the functional zone or sub-zone, the existing built environment and other applicable town planning conditions. For hotels, commercial and other non-agricultural developments, the need for a change of use must be assessed on a case-by-case basis in relation to the specific project and plot.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>First, you need to decide exactly what you plan to build or do on the plot. Changing the land use \u2018just in case\u2019, without checking the functional zone and development parameters, is the wrong way to go about things. In some cases, changing the land use will prove to be a necessary but insufficient condition.<\/p>\n<\/blockquote>\n\n\n\n<p>A separate scenario arises when a buyer is considering a plot of land in Batumi, Tbilisi, Gonio, Kvariati or another local market. The procedure for changing the designation falls within the remit of <strong>National Agency for the Public Register (NAPR)<\/strong>. This is not just a formality \u2013 it is the starting point for the whole process.<\/p>\n\n\n\n<p>You should check the following in the statement or information sheet:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Cadastral code<\/strong> plot \u2014 a unique identifier in the register;<\/li>\n\n\n\n<li><strong>Current role<\/strong> \u2014 agricultural or non-agricultural;<\/li>\n\n\n\n<li><strong>Category<\/strong> agricultural land (where applicable);<\/li>\n\n\n\n<li><strong>Owner<\/strong> \u2014 ensure that the data is up to date;<\/li>\n\n\n\n<li><strong>Restrictions and encumbrances<\/strong> \u2014 mortgages, seizures, easements and other restrictions on rights.<\/li>\n<\/ul>\n\n\n\n<p>NAPR provides a separate information service \u2014 compiling details on the designated use of a plot of land and its agricultural land category. According to <a href=\"https:\/\/napr.gov.ge\/en\/page\/fees-and-terms\/informational-services-fee\" rel=\"nofollow noopener\" target=\"_blank\">NAPR tariff data<\/a>, as at the time of writing, this service costs <strong>13 GEL<\/strong> (4 working days), <strong>26 GEL<\/strong> (1 working day) or <strong>39 GEL<\/strong> (on the day of enquiry). Please check the rates on the date of enquiry.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">2. Identify the purpose of the change<\/h3>\n\n\n\n<p>An application to change the designated use must be accompanied by a statement of reasons. The law does not provide for automatic approval at the owner\u2019s request \u2014 it is necessary to specify how the plot is intended to be used following the change of designated use.<\/p>\n\n\n\n<p><strong>The owner\u2019s wish alone is not sufficient grounds.<\/strong> The justification must relate to a specific intended use, which the law defines as a \u2018justified need\u2019. An application that is not sufficiently substantiated may result in a request for further information or a refusal, if the documents submitted do not demonstrate a justified need for a change of use.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">3. Check spatial constraints<\/h3>\n\n\n\n<p>Before submitting an application, you must ensure that there are no spatial or town-planning restrictions that could complicate or prevent the change of use.<\/p>\n\n\n\n<p>When considering an application, the NAPR is entitled to take into account data from the relevant local authority and the spatial planning conditions of the area. A special legal status of the area \u2014 for example, a buffer zone around a cultural heritage site or a nature conservation area \u2014 may restrict the permissible use of the plot and influence the decision on a change of use. The exact set of documents required must be confirmed for each specific application to the NAPR.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">4. Prepare and submit an application<\/h3>\n\n\n\n<p>The application is submitted to the NAPR.
