It is important to note straight away that the mere fact of owning a flat in Batumi or Tbilisi does not automatically mean you are obliged to submit a declaration. The key factor is the total the family’s income for the previous year.

In 2026, the rules changed significantly: the family income threshold, above which there is an obligation to declare ordinary assets, was raised from 40,000 to 100,000 lari. Some property owners who were previously required to pay tax may now claim an exemption — provided that their household income for 2025 did not exceed the specified threshold. However, for plots of land Separate rules apply, and the income-based exemption does not apply automatically in these cases.

The deadline for submitting the tax return in 2026 is — 2 November, payment of the tax must be made no later than 16 November. Filing a tax return and paying tax are separate obligations. However, it may not be necessary to resubmit the tax return if the information previously declared has not changed. The Georgian Tax Code (Articles 201–206) distinguishes between several categories of taxpayers and several taxation regimes — for ordinary property and for land.

If the household income for 2025 did not exceed 100,000 lari, the owner of a flat, house or non-residential premises is, as a rule, exempt from paying tax on such property and from the obligation to submit a tax return. Income exactly 100,000 lari does not exceed the threshold. However, if the property includes a taxable plot of land, the situation changes: a liability may arise in respect of the land regardless of the amount of income.

A tax liability arises where a household’s income exceeds 100,000 lari and there is taxable property, other than land. As a rule, a tax return must be filed; however, provided the details stated in the 2025 tax return remain unchanged, the Revenue Service permits the tax to be assessed automatically without the need to resubmit a tax return.

Who is required to submit a property declaration?

The situation

Filing of declaration

Reason

They own a flat; their household income for 2025 is 80,000 lari

Not required (based on income)

Income below the 100,000 lari threshold; assets other than land are exempt

They have a flat, and their household income is 120,000 lari

Required (or to be calculated automatically if the data remains unchanged)

Income exceeds the threshold; a tax liability arises

There is a plot of land subject to tax

A check is required in accordance with land regulations

Land is taxed separately; a family’s income does not automatically exempt it from tax

The flat is owned by several family members

Analysed as a family-owned business

The family is treated as a single tax unit when calculating income

The owner lives abroad

It depends on your tax status and income

Place of residence does not exempt one from this obligation; a status check is required

No property, but there is other taxable assets

It depends on the property category and income

Certain types of movable property may also be subject to tax

The property is situated outside Georgia

As a rule, this is not included in the Georgian tax return

Taxable items — property situated within Georgia

How to work out whether you need to file a tax return: four steps

Step 1. The concept of ‘property’ in the context of the Tax Code is broader than the familiar notion of ‘tax on a flat’.

Items that may be subject to tax for individuals include flats, private houses, non-residential premises, properties under construction, garages, as well as certain categories of movable property — for example, cars. Land plots constitute a separate category with their own rates and rules.

The terms ‘property tax’ and ‘real estate tax’ do not correspond exactly in Georgia. Property is part of taxable assets, but the tax return also covers a range of movable assets. That said, for the purposes of personal property tax, the main practical issue most often concerns flats, houses and land.

Check the registered use of the property and its characteristics. Both residential and non-residential premises may be subject to property tax; the liability and the tax base must be determined in accordance with the regulations applicable to the specific property.

Important: the tax rules for legal entities and sole traders differ from those for individuals. This article deals exclusively with individuals — citizens and foreign owners who hold property in a private capacity.

The exemption based on a family income threshold of 100,000 lari does not automatically apply to plots of land — Separate rates and terms apply for land, which are set out in the relevant section below.

How is household income calculated?

One of the most common sources of confusion is the belief that only the flat owner’s income is taken into account. The Georgian Tax Code considers the family as a unit of taxation: the income of several of its members is included in the calculation.

For the purposes of property tax, the family comprises the taxpayer, their spouse, minor children and stepchildren. Other relatives listed in the law are taken into account provided they live together permanently and share a common household. The composition of a family should be determined in accordance with the rules of the Tax Code, and not solely on the basis of registration at a single address.

A family’s total income includes:

wages each family member (the amount calculated, not the amount actually received after tax has been deducted);

income from business activities;

rental income — if a flat or other property is let, this income is taken into account when calculating the threshold;

Income from abroad — the rules for accounting for such income depend on the individual’s tax status and the applicable regulations.

However, the legislation provides for a number of important exceptions. Not included included in the total family income for the purposes of property tax: income from activities carried out under the micro-business scheme and the flat-rate tax scheme; the value of property received from family members by inheritance or as a gift; the value of property received following a divorce; certain proceeds from the sale of a house or flat that has been owned for more than two years. For an individual with the status of small businesses When calculating the threshold of 100,000 lari, the following is taken into account 25% revenue, which is subject to taxation under the special small business scheme. For other types of business activity, the method for determining taxable income may differ. Before determining the threshold, use the Revenue Service’s official calculator; do not simply add up all the household’s cash receipts.

It is important to take into account the income for the specific reporting period under analysis: for the 2026 tax return campaign, this is income for 2025.

The threshold of 100,000 lari refers to a family’s annual income, not to the value of the flat. The mere fact of owning expensive property does not in itself imply an obligation to pay property tax, except in cases governed by specific rules — for example, in relation to land.

Example 1. The husband earned 75,000 lari in 2025, and the wife earned 35,000 lari. The total household income is 110,000 lari, which exceeds the threshold. If the family owns a flat, they have a tax liability — they must either submit a tax return or ensure that the automatic assessment based on previously submitted data is correct.

Example 2. One family member received 60,000 lari, another 30,000 lari. That makes a total of 90,000 lari. This figure is below the 100,000 lari threshold, and provided that all other conditions are met, the flat (excluding the land) qualifies for exemption. There is no need to submit a declaration for such property, provided there are no other taxable assets.

It is convenient to check all sources of family income recognised by law using the Revenue Service’s official calculator: https://www.rs.ge/PropertyTaxIncome

Furthermore, it is worth distinguishing between two different obligations: ‘Taxation of rental income in Georgia"… and property tax are different taxes with different reporting rules."

Declaration for foreign nationals

A foreign national who owns a flat or a house in Georgia, is not exempt from the obligation to declare assets automatically. Citizenship in itself does not determine tax status nor does it exempt a person from financial obligations.

The key parameters are three independent factors: citizenship, tax residency in Georgia and the location of the property. A flat in Batumi or Gonio is subject to Georgian property tax, regardless of whether the owner lives in Georgia or abroad.

When it comes to the recognition of income, the situation varies. For Georgian citizens who are tax non-residents, the official Revenue Service provides for the determination of taxable income by source within Georgia. For foreign nationals, the rules for recognising income must be determined on a case-by-case basis, depending on the applicable provisions of the Tax Code and the circumstances of the individual taxpayer. It is not possible to automatically apply the rules for one category of non-residents to all foreign owners.

Buying a flat in Georgia does not automatically make a foreign national a tax resident countries. If the owner is unable to deal with the tax authorities in person, they are entitled to act through an authorised representative on the basis of a power of attorney. A Georgian tax identification number is required to submit a tax return via the rs.ge portal.

If a foreign national receives rental income from Georgian property, this income may, in principle, affect the calculation of family income for property tax purposes; however, the specific procedure for taking it into account depends on the applicable legislation.

For foreign nationals who are only planning to ‘How to buy property in Georgia“, it is advisable to familiarise yourself in advance with your tax status and any potential annual obligations.

What changed in 2026

In 2026, the key exemption threshold changed. In this case, the book value or cadastral value is not the starting point — it is the market valuation that is important. If you do not have a current market valuation, you can determine it yourself based on market analysis or by engaging a valuer.

As at what date should the market value be determined?

For the purposes of calculating tax in the 2026 tax return, the market value of taxable property, excluding land, is determined with reference to the previous tax period — as a general rule, as at the end of 2025. The value of a property stated in a purchase agreement does not always correspond to its market value for tax purposes.

For example, a flat might have been purchased for 180,000 lari, whilst its fair market value at the end of the reporting period was 200,000 lari. If the owner is liable to pay property tax, the calculation must be based on the relevant tax base, rather than automatically on the historical purchase price.

If you are unsure about the valuation, you should use market data for the relevant date or consult a valuer.

The statutory range of rates for property owned by private individuals (excluding land) is — from 0.8% to 1% market value. If an individual or members of their family owned taxable land within Georgia on that date, the obligation to file a tax return may arise regardless of the family’s income. In this regard, the exemptions provided for by law must be taken into account. The deadline for submitting the return for 2026 is — 2 November, payment of tax — 16 November.

Land is divided into two categories: agricultural и non-agricultural (others). The rates for these categories vary and are set at local authority level. In the case of joint ownership of a plot of land, each co-owner is liable for tax in proportion to their share.

Georgian legislation provides for certain exemptions from land tax. You must update the family details in your tax return.

The land had previously been declared. If the plot was owned as at 1 April 2026, it is necessary to check whether it constitutes taxable land and whether any statutory exemptions apply. Only after such a check can it be determined whether there is a liability for land tax.

If a previously submitted tax return contained an error, it can be amended: the Tax Code provides for a mechanism for submitting an amended tax return. It is advisable to check the current guidance from the Revenue Service for the procedure and deadlines.

Errors and liability

Common mistakes when completing a tax return are easy to avoid if you know where they most often occur.

Common mistakes and how to avoid them

Incorrect calculation of household income. Exceptions have not been taken into account — income from micro-businesses, inheritances, gifts from family members, and special arrangements for small businesses. Check each source of income using the official calculator.

One of the family members has been forgotten. Stepchildren are not included in the calculation. Please check the full composition of the family as defined in the Tax Code.

Site pass. A garage, non-residential premises or a plot of land are not included in the declaration. Draw up a complete list of properties in advance.

Incorrect value of the property. The historical purchase price was used without verifying the market value of the property as at the date applicable to the relevant tax period.

The wrong time. The return has been submitted for the wrong year, or the period of ownership of the property has been calculated incorrectly.

The land is not shown separately. The plot is included in the ordinary assets block, without taking into account its special status or the reference date of 1 April.

The tax return has been submitted, but the tax has not been paid. Please note: these are two separate commitments with different deadlines.

Late submission. In 2026, the deadline is — 2 November.

If you discover an error after submitting your tax return, do not wait for a notification from the tax authority. The Tax Code provides for the right to submit an amended tax return. It is better to correct the error yourself and in good time.

What penalties may be imposed for late submission and payment?

The Georgian Tax Code provides for separate liability for late submission of a tax return and for late payment of tax.

Under Article 274 of the Georgian Tax Code, where a tax return is filed late by no more than two months, the penalty amounts to 5% of the tax payable as shown on the return for each full or partial month of delay. The total amount of the fine is capped at 30% of the specified tax amount. If the delay exceeds two months, the fine amounts to 10% of the tax amount. If the tax amount shown on the return is zero, the fine under this article does not apply.

Article 272 provides for a penalty for late payment of tax — 0.05% of the outstanding amount for each day of delay.

Example: for an outstanding balance of 2,000 lari, the late payment charge at a rate of 0.05% is 1 lari per day. Over 10 days, this amounts to 10 lari, provided the outstanding balance remains unchanged.

The specific sanctions depend on the nature of the breach and the relevant provisions of the law.

Examples for property owners

Scenario 1. The owner of a flat in Batumi

The flat was purchased for personal holiday use and is not let out. The family consists of two people; their total taxable income for 2025 is 70,000 lari. As the income is below the 100,000 lari threshold, the flat qualifies for exemption. There is no need to submit a tax return for this property — provided there are no other taxable assets, including land. You can check that there is no tax liability via the service https://www.rs.ge/PropertyTaxLiability.

Scenario 2. A family with a flat in Tbilisi

The husband earns 90,000 lari a year, and the wife earns 50,000 lari. Their combined income is 140,000 lari, which is above the threshold. A flat with a market value of 250,000 lari must be declared (or will be subject to automatic assessment if a tax return for 2025 has already been submitted with the same details). At a rate of 0.8% (for illustrative purposes only), the tax will amount to approximately 2,000 lari for the full year. The actual rate is determined by a municipal by-law and can be verified using the official calculator.

Scenario 3. A foreign owner of a flat in Gonio

A citizen of another country, residing abroad, receives income there. The flat is owned by him as a private individual. The tax liability cannot be determined solely on the basis of nationality or the geographical source of the income: it is necessary to take into account the tax status in Georgia and the applicable rules for accounting for foreign income. A Georgian tax number will be required to interact with rs.ge; if necessary, you may act through a representative.

Scenario 4. Owner of a house and a plot of land

A family with an income of 85,000 lari owns a house and the adjoining plot of land. The exemption applies to the house: income below 100,000 lari. If the plot was owned as at 1 April 2026, it is necessary to check whether it constitutes taxable land and whether the exemptions provided for by law apply — only then can it be determined whether there is a liability for land tax.

All scenarios are hypothetical and are provided for illustrative purposes only.

How to avoid making mistakes when shopping

Tax liabilities arise not at the time of the sale of a flat, but whilst you own it. Therefore, when buying property in Georgia, it is wise to assess in advance not only the cost of the property, but also any potential annual expenses: “Property maintenance costs in Georgia"… include, amongst other things, taxes."

We bought a flat in 2026: when should we submit our first tax return?

If you purchased a flat in 2026, the obligation to declare it is usually assessed during the following tax year – in 2027. As a general rule, the family’s income for 2026 and the length of time the flat was owned during that year are taken into account.

For example, suppose you purchased a flat in September 2026. If you become liable for property tax in 2027, the calculation will need to take into account the period of ownership in 2026, rather than automatically charging tax for a full 12 months.

If you are purchasing a separate plot of land along with the flat, please check the land-related obligations separately: a specific procedure for determining the tax period applies to it.

Do not confuse the year in which the property was purchased with the year in which the tax return is filed. For ordinary assets, details relating to the previous tax year must be declared, whilst separate rules apply to land.

A few practical points to bear in mind when choosing a property:

Check the registered use of the property — both residential and non-residential premises may be subject to tax; please check the specific details for each property.

If you are buying a house, check whether the land is included in the transaction: this requires a separate check for any potential land-related obligations with a cut-off date of 1 April.

Obtain the property’s cadastral number and check the registered details of the property using an extract from the National Agency of Public Registry of Georgia (NAPR). This information will help you identify the property when preparing your tax return and verify its details before purchase.

Find out in advance whether an official market valuation of the property has been carried out.

Income from letting property may be subject to income tax and, at the same time, taken into account when calculating total household income for the purposes of property tax. These are two separate tax obligations, but rental income may affect whether the 100,000 lari threshold is exceeded.

It is also worth check the property before buying, to ensure there are no encumbrances.

Choose a property in Georgia, taking future costs into account

An apartment for a holiday, to let, or as a permanent home?
